Viamora — Terms of Service

_Last updated: {date}_

Welcome to Viamora. These Terms explain the deal between you and us when you use the app. We've kept the language plain. If anything is unclear, email us at info@lumeflux.io.

1. Acceptance of these Terms

By creating an account or using Viamora, you agree to these Terms. If you don't agree, please don't use the app. If you use Viamora on behalf of someone else (for example, a family trip), you confirm you have permission to do so.

2. Your Account

To use Viamora you need to:

  • Be at least 13 years old. If you're under the age of digital consent in your country, you need a parent or guardian's permission.
  • Provide accurate information when signing up (real name or chosen handle, working email).
  • Keep your password secure. You're responsible for everything that happens under your account. Tell us right away if you suspect someone else got in.

One person, one account. Don't impersonate anyone else.

3. Acceptable Use

Viamora is meant to capture and share travel memories with people you trust. While using it, you agree not to:

  • Harass, threaten, or harm other users.
  • Upload illegal content, including content that infringes someone else's rights.
  • Spam invitations to people who didn't ask for them.
  • Try to break, scrape, reverse-engineer, or overload the service.
  • Use Viamora to distribute malware or run automated bots against it.

We may remove content or suspend accounts that break these rules.

4. Your Content

You own everything you put into Viamora: your photos, videos, voice clips, trip notes, places, and itineraries. That doesn't change.

To make the app work, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your content to you and to the trip members you've invited. That license exists only so we can show your trip to the right people. It ends when you delete the content or your account.

We do not sell your content. We do not use it to train third-party models. We do not show it to advertisers.

5. Voice Recording & Transcription

When you record a voice memo, the audio is sent to Deepgram for transcription. We use the transcript inside your trip. The original audio file is stored with your memory in our storage so you can replay it — playback is a core part of the feature. The audio stays there until you delete the item it belongs to or delete your account, at which point it is removed along with the rest of your content. Deepgram's handling of the audio is governed by their API terms; they process it for transcription, not for training on your data.

If you don't want any audio recorded, stored, or sent to Deepgram, don't use the voice feature.

6. AI-Generated Content

Viamora uses AI to generate trip recaps, suggested tags, place metadata, and similar features. These outputs depend on model quality and can be wrong, incomplete, or weird.

AI output in Viamora is not legal advice, medical advice, financial advice, or guaranteed factual information. Double-check anything that matters (visa rules, opening hours, allergens, dangerous activities) with an authoritative source.

7. Service Availability

We do our best to keep Viamora running, but we don't promise it will always be available, fast, or bug-free. The free tier has no service-level agreement (SLA). We may change, pause, or shut down features with reasonable notice.

8. Termination

You can delete your account at any time from the app's settings. When you do, your content is removed from our active systems (some copies may persist briefly in backups before being overwritten).

We can suspend or terminate accounts that violate these Terms, that we believe pose a security or legal risk, or that are inactive for an unreasonably long period. Where reasonable, we'll let you know first.

9. Warranty Disclaimer

Viamora is provided "as is" and "as available." We make no warranties — express or implied — about merchantability, fitness for a particular purpose, accuracy, or non-infringement. You use the app at your own risk.

10. Limitation of Liability

To the maximum extent allowed by law, Viamora and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost travel opportunities arising from your use of the app. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (which, for free-tier users, is zero).

Nothing here limits liability that cannot legally be limited (for example, gross negligence or intentional harm).

11. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes will be handled by the competent Dutch courts.

12. Changes to these Terms

We may update these Terms over time. For meaningful changes, we'll give you at least 30 days' notice through an in-app message and an email to your account address. If you keep using Viamora after the notice period, you accept the new Terms. If you don't agree, you can delete your account.
